My mom told be that when im with her tummy bear she’s always angry, can’t sleep well and eat lots of food. She was always fighting with my father that time. During my christening, they told me I have more than 20 Godmothers and Godfathers. Back when I’m months old, my mom said, she doesn’t like other people kissing me, except to all my Godparents, because she doesn’t like me to smell bad or even get dirty. She even told me that I cry a lot. She also told me that I only have 3 colors in all my clothes; pink, yellow and white. Then, during my Kinder days, I became a Twinkle Star in our Girl Scout. I was so shy and as I remember, I was so sick. Back then, if I’m not feeling well and my tummy is aching, I immediately throw up. I cry and cry because all I wanted that time is to go back home, I really hate mosquito bites. In Grade 1, during the Foundation day, our class presents a dance and I was in the back row because I don’t know how to dance. That’s my weakness, so I do everything, and practice a lot, then in grade 2, I was in the front row and became the leader of the group, and our principal was sitting in front of me. There was a point in my Grade 1 life that my teacher always gets mad at me, because I always bring attitude to school. It’s because at home, I am a spoiled brat, my parents always give me what I want . In Grade 6, I always make fights, I’m so bully and I am so confident in myself, because I am always a muse in our class . And in High school, there was a time, that some of the school leaders choose me to be their representative as Ms. Intrams. I became 1st runner up in the Ms. Girl scout of all entire Makati. I also became Lakambini SA buwan ng wika, which makes my mom proud. All about the that special event in my entire high school life, my mom is always there to support me. Even if the gown is expensive, she still bought it for me. And as I remember, she even registered me to one of this workshop, which is a ramp model. She wants me before to be an artist. Half a month of my 3rd year high school, I met a church that’s â€Å"Victory Fort†, that was the time I realize everything. What Christ did for me, â€Å"Salvation†. It made me realize how strong the Gospel is, the moment Christ sacrifice himself at the cross, to forget all our sins and to let us all live. God reveals so many things to me, and during March 23, 2013 I was baptized with the Holy Water. I was born again. I know the real Elaine, the real me. When I was in my last year of High school, it was the happiest year of my life as a high school student. All of my classmates are so close to me and we all wishes to have pictures together with all our teachers. And during our JS Prom, I felt so elegant with my dress, my friends were shocked with the way I dressed up. It was way too far from the real Elaine. Whenever I’m bored or nothing else to do, I just enjoyed playing chess with my siblings, friends or parents. The people involve in this church, they were the ones who let me see how important my life is, my body and they remind me what did Jesus Christ do to me just for me to live and how strong His Love, Mercy and Grace for us. It tasted as bitter as always, but as I drank, Markelle lifted her eyes. There was nothing obvious in them, no wink, no expectation. Yet, somehow, I knew. I knew. It was the fake again. Satisfied that I'd swallowed it all, Abigail gave me a withering glance. â€Å"We need you cleaned up. That fool is coming for you again later tonight, and he did a number on that dress last time. Naturally, I couldn't tell her that my dress's rumpled and slightly torn state had nothing to do with Leith's sexual aggression, but, rather, an angry spirit bent on killing me. Markelle's eyes were downcast once more. â€Å"Should I get her a new dress?† â€Å"No. You've got to clean up too. Art's going to be here in a little while for you.† The girl flinched, but Abigail didn't seem to notice. But then, why would she? She didn't notice any of these girls, not really. And I knew what those words meant. Markelle's time had come. â€Å"I'll send in that freckled one, once she wakes up again.† I realized that she was me and that I should allegedly be going under. I sank back against the covers, blinking like I was trying to stay awake. The two of them left, Markelle giving me one last fleeting glance. There were a lot of things in her wide eyes as she looked at me. Fear. Hope. Anxiety. I exhaled once they were gone and sat up. Plan time. My muscles were still weak, but they reminded me more of what you'd feel after a hard run. What had Markelle said before? Twelve hours was the normal dose? I was at that point. I had to use this downtime to assess the situation. Abigail was in the house still. Art and Leith were eventually coming back-together or apart, I didn't know. The one thing I felt confident of was that I did not want to face all of them at the same time. That meant Abigail had to be taken out first, but I was going to need help. In what must have been a little over an hour, Cariena slipped in with a pink silk dress. It reminded me of something Maiwenn would wear. Apparently, no one had gotten the memo that redheads don't wear pink. I stood up and took the dress from Cariena, promptly tossing it on the bed. She looked aghast that I'd gotten up without falling over. One where they keep cars.† I recalled the garage but didn't know if it connected directly to the house. Surely she knew what a car was. She nodded. â€Å"Yes. They go in and out of it sometimes. I know what we're going to do. Take me to Markelle.† There was a moment's hesitation, and I knew this was the turning point of whether she could help or not. Markelle understood instantly, and although Cariena still seemed terrified, she also appeared determined. I returned to my room, body tensed for action as I waited for my plan to unfold. Pressing my ear to the closed door, I listened as Cariena's feet thudded up the stairs. Presumably she spoke to Abigail, but I couldn't hear anything. A few moments later, two sets of feet came downstairs, walked past my room, and went to Markelle's. I opened my door a crack to make sure the hall was empty. Next door, I could hear Markelle having the nervous breakdown we'd planned-saying she was afraid to leave, afraid to meet this man, didn't know what to wear†¦. Abigail, clearly irritated, began to scold her, much as she had responded to Leith's whining. I waited to hear no more and turned in the opposite direction, heading for the stairs. When I reached the main floor, I did a double-take. The house was beautiful, all new construction and designer decorating as befitted the neighborhood Art lived in. The gentry sex dungeon below us kind of detracted from the maple cupboards and crown molding, though. All the curtains were closed, the windows covered with iron grating, and outside I could just barely make out the Sleeping Beauty hedges blocking the windows too. Art's lawn maintenance had been about more than aesthetics. The patio drapes I'd so admired weren't laced with silver thread. It was iron. The garage was adjacent to the kitchen, just as Cariena had said. The top half of the door leading out to it had a window covered with more iron grating. I turned the doorknob. Locked. There were no signs of keys anywhere, which meant I'd have to do it the hard way. First, I double-checked the kitchen and living room, looking for any other weapon options. On a good day, I could have taken Abigail with my own fists. This was not a good day. Kitchen drawers revealed butter knives, nothing sharper. With a sigh, I returned to the garage door. This was it. The grating was loosely bolted, enough to keep it up and prevent the girls from touching it. Hoping I'd gained enough strength, I gripped the sides of it and tried to jerk it off. For a moment, nothing happened. Then, in one movement, it ripped from the wood. I froze, waiting to see if anyone downstairs had heard, but the deed appeared to have been performed fairly silently. The next part, I knew, would not be so quiet. I dragged a chair up to the door and then grabbed a smaller stool used to get into high cupboards. It was metal and had some heft to it. Would it be enough? I stood on the chair and swung the stool forward into the door's window. Yup. Enough heft. More than half of the glass broke. One more swing got the rest of it out, and I climbed through the hole into the garage. The whole maneuver was a bit awkward on my part; I wasn't in that good of shape yet. But, I made it through, incurring only a few cuts on my arms and legs. I knew, however, I was seconds away from Abigail's arrival. There was no way that breaking glass had gone unnoticed. Small patches of light streamed into the darkened garage from narrow windows as I peered around. Yes, it was a normal garage-albeit it one with a Jaguar in it. I guessed that was why Art had to keep the SUV in the driveway. Part of me wanted to go kick in the car's door, but there was no time. I had to assess the garage's other contents. Scattered tools. Bags of fertilizer. Art's gardening equipment. A heavy metal wrench held my attention for a moment, but then I decided I needed more leverage with my weakened state. I selected a shovel from Art's gardening stash, its scoop heavy metal and wooden handle sturdy. From inside the house, I could hear shouting. It wasn't going to take Abigail long to figure out where I'd gone when she saw the glass. Grateful for the darkness, I darted over to the side of the door that led into the house, pressing myself as flat as I could against the wall. There was a click as the door from the kitchen opened, but no one came out right away. I could picture Abigail standing there, looking around for any sign of me. After several heavy seconds, I saw a hand holding a blade-an athame-come out the door first, defensively positioned in case I came charging at her. That wasn't my intent, though. I wanted to get her from behind. She took one step out, still cautious and slow, looking around everywhere. I had to give her credit for that. She didn't just barrel forward; she knew I might be waiting by the door. And in fact, when she looked in my direction, that's exactly what I was doing. My shovel hit her in the side of the head before she could react. She crumpled to the ground, athame clattering against the concrete floor as it fell from her hands. I knelt down and immediately scooped it up and left the shovel. There was a bloody mark where I'd struck her, and her eyes were only half-open. My hand checked her pulse and found she wasn't dead yet. She was going to have a hell of a headache or concussion when she woke up-which wasn't something I could allow to happen any time soon. I left her lying there on the garage floor and stepped back into the kitchen. I opened a few cupboards and found what I'd hoped I would: the household's stash of medicine. Tylenol, multivitamins, et cetera. Behind them were a couple of prescription bottles. One I didn't recognize, but I thought it was some sort of heart medication. The other was Ambien, and I smiled. Just like me, a lot of shamans were insomniacs. I popped a pill out of the bottle, reconsidered, and grabbed a second. I then propped up Abigail and managed to shove the pills down her throat, with the help of a glass of water and some acrobatics with my fingers. â€Å"Payback's a bitch,† I said when her reflexes kicked in and she swallowed the pills the rest of the way. She wouldn't be waking up any time soon. I stepped back into the kitchen and saw all three gentry girls standing there and staring at me. Cariena and Raina looked afraid. Markelle, though she bore a red slap mark on her face from the confrontation earlier with Abigail, looked excited and defiant. I ordered them to carry Abigail downstairs and lock her in one of the rooms. I didn't know which way Art would enter the house and couldn't risk him finding her on the garage floor. Of course, if he did come in through the garage, the shattered glass was going to be a dead giveaway that something was up. Before they took Abigail away, I frisked her, hoping to find another weapon. Nope. Just the athame I'd already taken. I did, however, discover something nearly as useful: a set of keys. On the ring were several tiny keys, the ones that opened up the iron cuffs and bracelets the girls wore. Once they'd stashed Abigail away, I removed all the iron. Relief flooded the girls' faces, and I scowled when I saw the welts and bruises left from where iron reacted with gentry skin. â€Å"You should have your magic back,† I said, reaching for the phone. â€Å"We can use it when we get out of here. What can you guys do?† I was dialing Roland's cell phone, and the girls described their magic to me as the line rang. Cariena had a knack for helping plants grow, kind of like Shaya. Raina had some healing ability. Markelle could summon beams and balls of light. I disconnected when I got Roland's voice mail and promptly dialed Kiyo. â€Å"Son of a bitch,† I muttered. None of the girls' powers were going to help us. And honestly? It wasn't a surprise. If I were Leith and had wanted to catch girls who would make docile servants, I too would have picked ones with little or no offensive magic. Kiyo's phone rang only once before going to voice mail, meaning it was off or he was in the Otherworld. I hung up and prepared to dial my parents' home number. If Roland hadn't answered his cell, he likely wasn't home either, but I had to try. Before I could punch in the numbers, I heard the sound of keys at the front door on the far side of the house. I turned to the girls. â€Å"Downstairs!† I hissed. â€Å"Now!† Markelle looked like she would have stayed, but a stern glance from me sent her scurrying down with the others. Meanwhile, Art's voice rang through the house. â€Å"Abigail?† I'm not sure how he knew something was wrong. For all he knew, Abigail could have just been downstairs. Maybe it was just some sixth sense, but I heard him hurrying down the hall toward the kitchen, footsteps fast on the hardwood floor. I had a split second to react, no chance to find a hiding spot as I had with Abigail. Surprise was my greatest weapon now. As soon as he entered the room, I leapt on him with the athame. The thing that gave me a fighting chance was that he'd armed himself too well in his wariness, a gun in one hand and an athame of his own in the other. Full hands prevented him from fully deflecting my attack, though in many ways, the strength of his arms were more than good enough to block the worst of it. I got a swipe in on his face, however, gaining a fair amount of satisfaction in seeing the blood it produced. â€Å"You bitch,† he said, circling with me in the kitchen as we each sized each other up for an attack. â€Å"Where's Abigail?† â€Å"Taking a nap,† I said. I gave him a wicked smile, hoping I sounded stronger than I felt. With that one shove alone, I'd been painfully reminded that I was not in peak condition quite yet. I couldn't let him know how weak I was. â€Å"Don't worry. You can join her.† â€Å"I knew I shouldn't have let him keep you here,† Art growled. â€Å"I should have made him drag you back by your hair to your own fucking world like a caveman. But he was too afraid they'd find you.† â€Å"It's too late. They know I'm here already. See the phone? I got a call in just before you arrived.† A lie, but an effective one as it turned out. Art's eyes flicked to the portable phone lying on the kitchen floor. It had come open when I dropped it, and the battery lay nearby. With that slight distraction, I tried again, lunging toward him. I got a kick in-not as strong as one of my usual ones, particularly since I was still in that fucking gentry dress-but enough to throw him off-balance. He was still stronger and faster, though. He'd dropped the athame earlier and grabbed me with that free hand, wrenching my arm painfully to get me to drop my athame. In his other hand, he held the gun but seemed hesitant to use it. At last, his hand was too strong, and my fingers unclenched, releasing the blade and leaving me defenseless. Triumphant, Art slammed me back against the cupboard and tried to turn me around, probably to bind my hands. I'd noticed a glitter near his pocket earlier and suspected he had handcuffs on him. I fought him the whole time, refusing to turn around, and with only one hand free, he had a bit of difficulty in maneuvering me. â€Å"Stop struggling, or I'll blow your head off,† he yelled. â€Å"No one's coming, and you know it. Play nice, or there's nothing that Leith can offer me to keep you alive.† â€Å"I doubt that. Your whoring operation seems to bring in a lot of money. Are you going to give that up so easily?† â€Å"There are other ways to get gentry girls,† he grunted, still trying to shove me around and subdue me. The unfortunate thing was, he was getting closer. My strength was rapidly fading. â€Å"Other people will make deals. I don't need Leith or his half-breed whore to-ah!† I saw the chair before I saw Markelle. It was the one I'd used to climb through the garage door. Abigail had shoved it aside when she went outside, and now Markelle had snuck up and clobbered Art with it from behind. It was hardly a blow to render him unconscious, but it caused him to release me and stagger back. Markelle immediately scrambled away, but Art's attention wasn't on her. His eyes were back on me. Weak or not, I knew I had to use that opening to take him down. I surged forward again, fists ready and- He shot me. So help me, that bastard shot me. The bullet took me in the right shoulder, and I flew back against the cupboards, sinking down to the floor as my left hand instinctively flew to the wound to stop the blood. Art walked swiftly toward me, gun pointed down. â€Å"The next one goes through your heart,† he said. â€Å"Now turn around and put your hands behind your back.† â€Å"I'm kind of fucking bleeding here,† I snapped back. My shoulder was on fire, and I couldn't even really move my arm. â€Å"How much more incapacitated could I get?† His smile was bitter. â€Å"Eugenie, you won't be incapacitated enough until you're dead.† I saw Markelle come up behind him again. Her chair was gone, but her fists were out as she pounded him on the back, desperately trying to get him away from me. It was noble and tugged at my heart, but I wanted to yell at her to get the hell out of here. She was no more than a mosquito to him. With ease, he turned around and backhanded her, and I swear, she hit the floor harder than I had when I was shot. In those fleeting seconds, I snaked one of my feet out as hard as I could manage and hit Art in the shin. He stumbled, leg buckling, but didn't fall. The gun, however, did fall from his hands. It hit the floor with a clatter and slid far out of my reach-but not out of Cariena's. She'd apparently been standing on the far side of the kitchen this entire time. When the gun slid up to her, the timid girl didn't hesitate. She picked it up-screaming as her fingers made contact with the metal and polymers-and slid it back across the floor to me. I grabbed it. All the while, Art's eyes had been following the gun's journey, so when it came to my hand, he was facing me. I had the gun aimed in a flash, and while I wasn't a great shot with my left hand, I wasn't horrible either. No hesitation: I fired. The bullet bit into his chest, and he fell backward, blood immediately pouring from the wound. I'd hit the mark. Markelle and Cariena ran up to me, Raina following moments later. â€Å"Are you all right?† exclaimed Markelle. â€Å"Me?† I asked incredulously. â€Å"He smacked you across the room.† She shrugged. â€Å"They've done worse since I've been here.† Between the three of them, they managed to help me to my feet without putting too much pressure on the wounded shoulder. Raina attempted some of her healing magic-maybe I'd been too quick to dismiss their powers after all-and we found bandages to wrap the wound. Her power only lessened the pain; she could do nothing more extensive. â€Å"It's made of iron,† she said apologetically. Of course it was. Art would have had it loaded for wayward gentry. â€Å"It's okay. I'm fine.† We were back in the kitchen, and I was leaning against the counter, attempting to straighten the bandage. We were all kind of trying to ignore Art's body. â€Å"Okay. I can try to call for help again, but I think we need to get out of here on foot. I know where the gateway is, and it's kind of a long ways, but we should be able to-â€Å" â€Å"Eugenie? What's going on?† I'd set the gun on the counter while tugging my bandages straight, but in the blink of an eye, the revolver was back in my left hand, pointed toward the new addition in the kitchen. I knew the voice before I saw the face. How could I not? I'd been listening to that voice over and over this whole week, both sleeping and awake. A voice that was a contradiction because it promised love and devotion while only delivering pain and humiliation. I'd numbed out the worst of it with sheer will and the nightshade's effects. But now, pumped full of adrenaline, on the verge of escape and in control of my senses, the true magnitude of it all slammed into me. The horror. The terror. The helplessness. Emotion after emotion burned through me, but in the space of a breath, my mind immediately dispatched any feelings that wouldn't help me right now. That left only the dark ones. Rage. Fury. Malice. I tightened my hold on the gun and narrowed my eyes at the man I hated most in the world. â€Å"Hello, Leith.†

Many adolescents who are working hard to become the best in their league are now falling short due to overuse injuries. With childhood obesity increasing, U. S. citizens have overlooked the overuse injuries that affect the active youth. In 2003 more than 3. 5 million children under age 15 suffered a sports injury that required medical treatment, thats about one attended injury for every 10 players, and seventy-five percent of those injuries were the result of overuse (Hyman, 2009). Overuse injuries occur over a long peroid of time and occur after repetitive micro trama to th tendons, The human body has the tremendous capability to adapt to physical stress. However if the body is put under to much stress without the proper amount of rest injury can occur. The most common injury that occurs from this is an overuse injury these include tennis elbow, runners knee, and shin splints. There are three main factors that are contributing to young athletes getting an overuse injury. The first factor is that these young athletes are being trained by parents and coaches who have no background in sports. These inexperienced coaches are providing the young athletes with improper training techniques, which can result in injury. Another factor that is leading to overuse injuries is the amount of pressure being placed on the athlete by coaches and peers. Wether it is a coach teaching their athletes to play through the pain, or parents pressuring their children so they can live vicariously through them, the well being of these young athletes is getting overlooked. The final factor stems from the previous two factors. Coaches are pressuring athletes to become specialized meaning they only participate in one sport. While this alone is not an issue, whats wrong with this is they are being improperly trained year round and rarely are given the rest needed to stay healthy. The effects of these injuries are serious for all athletes, but for the young growing athletes these injuries could lead to bigger problems. For example the stress fractures could effect the growth plate in some athletes. According to Overuse Injuries in Young Athletes the growth cartilage is most vulnerable to repeated micro traumas. This could lead to certain muscles developing faster than the bones they are attached to. Forcing them to attach to a different part of the bone, constricting it and not allowing it to grow properly(Johnson, 2005) Another damaging cause of overuse injuries is arthritis while overtime everyone will at one time get arthritis of some sort in the joints, for those athletes who have sustained many overuse injuries may obtain it at a much younger age. The treatment for overuse injuries depends on the specific diagnosis. This is very important for treating the early symptoms of overuse injuries. Working with a coach or teacher or taking lessons can assure proper training and technique. Paying particular attention to proper warm up before activity and using ice after activity may also help. Aspirin or other over the counter anti-inflammatory medications can also be taken to relieve symptoms. If symptoms persist, a sports medicine specialist will be able to create a more detailed treatment plan for the athletes specific condition. This may include a thorough review of the training program and an evaluation for any predisposing anatomic or bio-mechanical factors. Legal & ethical Essay

This essay is based on a case scenario and will critically analyse the ethical dilemmas that health and social care practitioner’s encounter with regards to: implications of consent, disclosure of personal information and maintaining patient confidentiality. The legal aspects of the scenario will be discussed in relation to the breaching of confidentiality and how the Data Protection Act (1998) can conflict with other legislation intended to protect patient’s rights. In addition it will identify the consequences of non-disclosure in comparison to disclosure without consent, whilst adhering to the General Medical Council (GMC) guidelines. Finally it will explain the scenario from a utilitarian viewpoint as well as deontological perspective. Please refer to appendix for case study. In the case scenario, Dr Gomez’s patient Bob is diagnosed with Human Immunodeficiency Virus (HIV), and has been advised to inform his partner Sue of his condition. Sue is seven months pregnant with their first child. However, on a subsequent visit to the clinic, Bob has indicated he has not notified his partner or previous sexual partners of his HIV status. Dr Gomez once again tries to persuade Bob to divulge his condition, he emphasises the importance of Sue being tested for HIV, and just as importantly the necessity to assess whether the baby is at risk. Meanwhile however, Bob is still adamant he will not notify Sue and says that if his HIV is disclosed to her without his consent he will discontinue his course of treatment, which he began on the previous visit. There are guidelines and legislation in place to assist the health and social care professional in making decisions. The law (GMC, 2001) states doctors are legally committed and duty bound to maintain their patient’s confidentiality. In this scenario the doctor is presented with both an ethical and legal dilemma. According to Sussex et al (2008) an ethical dilemma arises when there is no clear solution to a problem. The ethical dilemmas that Dr Gomez is concerned with are the wellbeing of Bob, Sue, the unborn child and Bob’s previous sexual partners and finally the legal dilemma is the possible breaching of Bob’s confidentiality by informing Sue of her partners HIV status. Gallant (2008) describes HIV as a virus which attacks the immune system, thus weakening the ability to fight infections and disease, eventually the body becomes incapable of fighting off infection and this is when the Acquired Immune Deficiency Syndrome (AIDS) develops. Gallant goes on to say there is no cure for HIV however, if the condition is  detected in the early stage, there is available treatment which help the infected person live a longer life than they would without intervention. Kourtis and Bulterys (2010) declare HIV can be transmitted through unprotected sex and also from mother to unborn child. From that information it could be argued that if the doctor did not inform Bob’s partner of his condition then it could have serious health implications to her and the unborn child. Thorne & Newell (2005) suggest that if the mother was already infected the virus could be spread to the baby through several ways, such as; via the placenta, during a virginal birth or when breast feeding. The GMC (2001) states that confidentiality is an important duty but not absolute, and they further outline the behaviour expected by medical professionals. In addition they state personal information can be disclosed without consent in exceptional circumstances such as, when disclosure is of interest to the public because they or the patient may be at serious risk. The National Health Service Act (2006), section 251 (Legislation 2006) mirrors the GMC by stating that confidentiality can be breached when a healthcare professional makes the decision to protect others, this is re-enacted in section 60 (1b) of the Health and Social Care Act (2001) (Legislation 2001). In addition Aidsmap (2010) indicates the Health and Social Care Act (2008) made changes to the Public Health (Control of Disease) Act (1984) by adding Part 2A. The article goes on to say the updated Act introduced what is known as the ‘all hazards’ approach in relation to public health powers. This means instead of specifying in law a list of infections to which public health powers can be applied, any infection could be subject to public health powers if the infection ‘presents or could present significant harm to human health’ and if the infected person ‘might infect others’ [Part 2A section 45G]. This implies Dr Gomez has a duty to breach his patient’s confidentiality and inform Sue of Bob’s condition. However, these afore mentioned Acts infringe article 8 of the Human Rights Act (1998) (Legislation 1998) which states patients have the right to have ‘respect for private life and family life.’ Leading on from that; it is vital that health professionals are aware of their legal, ethical and professional position as Mason et al (2002) implies confidentiality is at the heart of the code of ethics for medicine. For these reasons it is imperative professionals working in this field are aware that article 8 of the Human Rights Act (1998) can be cancelled out by both the Data Protection Act (1998) (Legislation 2012) and the Public Interest Disclosure Act (1998) (Legislation 1998). Eckstein (2003) indicates that the Data Protection Act (1998) (Legislation 2012) gives guidance on the use and storage of confidential information and also states the circumstances when confidential information can be disclosed in order to protect others so long as the action of disclosure can be justified. The Medical Protection Society (2012) states a justifiable reason for breaching a patient’s confidentiality would be when a patient has a communicable disease and is in jeopardy of putting others at risk. Legislation is not the only factor which influences decision. Hepworth et al (2011) indicates that it is important that professional healthcare workers understand they could intentionally or unintentionally be prejudiced by their own ‘personal’ values. The Oxford Dictionary (2001) defines ‘value’ as: the worth, desirability or utility of a thing, or the qualities on which these depend. Therefore before making a decision on what to do, Dr Gomez will have to ensure that his ‘personal’ values will not influence his decision or more importantly conflict with his patient’s values or legislation. Clarke (2000) cited in Holland (2004) suggests a doctor may feel responsible for his patient refusing treatment if he discloses without permission, as the patient is his first priority and must come first. At the same time Dr Gomez could equally feel a conflict of responsibility towards Sue and her unborn child, firstly because if she is not told of the situation and then at a later date she and their child are diagnosed with HIV, it would mean that their HIV status may be more advanced with the prolonging of treatment. Secondly the child may well have not transmitted the condition if there had been an early prognosis. On the other hand if Bob discontinues with his treatment it could have devastating and irreversible effects. As reported by The AIDS Beacon (2011), consequences of interrupting or stopping treatments can have a detrimental effect. They indicate those who interrupt treatment are more prone to opportunistic infections as well as HIV related illnesses such as shingles, Candida infections, and Non-Hodgkin’s Lymphoma, than those who had no treatment interruptions. Furthermore, they conclude patients with treatment interruptions have a slightly higher HIV-related death rate compared to those with no interruptions. According to the GMC (2001), Dr Gomez is duty bound to respect Bob’s right to choice in refusing treatment. Jackson (2006) implies two of the most important core principles when working in medicine are obtaining consent and respecting the patient’s autonomy. Whilst Beauchamp and Childress (2001) describe autonomy as being akin to self-governance, for example being able to understand, reason, deliberate and have the capability to independently choose. To apply their definition to this situation Dr Gomez should once again try to persuade Bob to confide in Sue, whilst informing him of and ensuring he understands the risks he imposes to her, the unborn child and himself if he discontinues treatment, thus empowering Bob to act autonomously through understanding, taking responsibility and control of his situation. Beauchamp and Childress (2001) further argue that some people fail to self-govern in some situations because of restrictions caused by illness, depression or ignorance. If after giving all this information to Bob and he still refuses to confide in his partner, it could result in the forcing of the doctor to act in a paternalistic manner, meaning that he will have to make the decision for Bob. This according to Jackson (2006) would infringe on Bob’s right to autonomy. Leading on from this, it is equally important the doctor should explore the reasons as to why Bob does not want to disclose to Sue. According to The Free Dictionary (2009) to give consent to something; means that the patient must agree to the medical professional sharing their medical history. Research conducted by Cameron et al (2005) suggests that a person with HIV, reasoning for withholding consent could be due to the fear of rejection by their partner, they go on to imply that a HIV impaired person is not withholding out of maleficence but rather that the patient may be trying to balance deontology with utilitarianism. Bernat (2008) states, Kant was the founder of the modern school of deontology and he goes on to define deontology as an ethical theory that the morality of an action should be based on whether that action itself is right or wrong under a series of rules, rather than based on the consequences of the action. Kant believed that we should never tell a lie no matter what the consequences. According to Morrison (2009) critics of Kantianism argue that deontology is inflexible as it means that an action is either right or wrong, with no ambiguity whatsoever for example; lying is always wrong, even if the lie is to avoid hurting someone’s feelings. Ross (1994) cited in Littleton and Engebretson  (2002), argues that deontology is insufficient to guide all decision making in ethical situations. Mill (2009) believes that utilitarianism is when a morally right act has to bring about the greatest happiness for the majority of people. Though he did express that if an act was carried out for the purpose of good intent but later that act concluded with a negative impact then it would be deemed immoral. Both utilitarianism and deontology theories have strengths and weaknesses. Williams a critique of utilitarianism (Smart and Williams, 1998) argues that happiness is an emotion which cannot be quantified or measured and that utilitarianism means any action could be deemed moral in the pursuit of happiness such as genocide, torture and killing innocent people. Holland (2004) states that when balancing the rights and wrongs of a situation it is known as performing a utilitarianism calculation. This process is achieved by considering both utilitarianism and deontological perspectives when making an ethical decision. Morrison (2009) states that Kant believed a moral person is one who would be honest and considerate and therefore he would argue that the doctor would also be acting immorally by wanting to disclose to Sue and thus breaking Bob’s rights to confidentiality. Whereas from and utilitarian perspective Mill (2009) would argue that Dr Gomez should breach Bob’s rights in order to protect Sue and their unborn child as it could be argued that Dr Gomez would be doing this for the greater good of many. In addition if Dr Gomez did not inform Bob’s partner of his HIV condition then he would also be breaching the General Medical Councils guidance, as stated previously. This failure could then lead to Dr Gomez being disciplined, as he is duty bound as a doctor to protect others from serious communicable diseases, which is a justifiable reason for breaching the confidentiality of a patient (GMC 2001). At the same time it could be reasoned Bob does not want to disclose to Sue because of fear of discrimination. The Terence Higgins Trust website (2012) states that a 2010 survey revealed 66% of the public believed that there is still a stigma attached to HIV. The findings go on to say that a huge majority of discrimination is found within the National Health Service, encountered from the likes of healthcare workers, dentists, general practitioners and hospital staff. It continues by saying HIV prejudice can compromise personal relationships and that fear and isolation can lead the infected person to mental health issues such as depression. The website  goes on to express that these findings are supported by a 2012 study which highlighted one in four HIV infected people had a current depressive disorder. The article further goes on to suggest that legislation such as the Equality Act (2010) (Legislation 2010) gives people living with HIV protection against discrimination but also argues that it does not always stop injustices, and when discrimination occurs it can be expensive to take legal action, especially with the current government cutting back on the legal aid budget. When it comes to making a difficult decision it could be argued that health and social care workers need the support of colleagues. Doctor Gomez may which to seek advice to help guide him in the situation, and the medical practitioner under the GMC (2001) guidelines is within his rights to discuss the situation with a colleague so long as this is done anonymously when consent is not given. This means that in accordance with the Data Protection Act (1998) the name, date of birth, gender, address and contact detail should remain confidential. However, Dr Gomez still needs to protect his patient’s wishes to confidentiality even when consulting with another medical professional for example, Bob’s General Practitioner (GP). Although HIV is infectious it would not be deemed as putting the GP at unnecessary risk by not disclosing, as universal precautions, such as protective gloves, are in place to protect individuals from infection, this indicates that if the GP follows these precautions they will be safe from contracting the infection (GMC, 2001). As previously mentioned HIV can be spread from mother to unborn child, this is another important reason why either the doctor or Bob need to inform Sue, for both her and the child’s health and safety. Porter et al, 2003, cited in Thorne and Newell (2005) convey the findings of a 2003 study, which indicated that two million women became newly infected with HIV mainly through heterosexual transmission and that 630,000 children acquired the infection mostly through mother-to-child transmission in the same year. The article continues by stating that without antiretroviral therapy the median time between primary infection and the development of AIDS is approximately ten years, and AIDS to death around two years. Thorne and Newell (2005) further states and highlights that the use of antiretroviral therapy substantially delays the progression of HIV and are highly effective in reducing the transmission from mother-to-baby. In addition it also recommends the baby be delivered  via an elective caesarean section, before the onset of labour and membrane rupture, furthermore it advocates the use of formula feed rather than breast feeding. Finally, Thorne and Newell (2005) reveal that since 1999 all pregnant women are offered the option of being tested for HIV as part of their antenatal care, again this emphasises the need for Sue to be aware of her partners condition so as she can make an informed decision as to whether or not she should be tested. If Sue has not contracted HIV yet, she is still at great risk of doing so as HIV is spread through infected semen (NHS Choices, 2012), she and Bob may well be having unprotected intercourse due to her already being pregnant; as it is not necessary for them to use contraception to prevent an unplanned pregnancy. All this suggest Dr Gomez would be advised to take the utilitarian perspective in the case scenario, as there would be too many consequences for him if he took the deontological approach. He could not legally or morally justify non-disclosure. Finally, according to Rowe et al (2001), who carried out a study, on behalf of the World Health Organisation, in order to identify any inequalities within the treatment of patients, suggest it would be advisable for the local authorities to perform a Health Needs Assessment (HNA) of the local community. They explain the stages as a process which describes the health of the population, highlights major risk factors and causes of ill health and identifies the actions which are needed to address these issues. Rowe et al go on to recognise Bradshaw’s taxonomy of needs (Bradshaw 1972, cited in McLachlan 1972) they convey these needs as ‘normative’, for example the medical definition of HIV. The ‘felt need’, such as the need to have advice on having safe sex, the ‘expressed need’ for instance seeking advice about safe sex and finally the ‘comparative need’, offering a service that gives guidance on safe sex, only to those of a legal age. Rowe et al go on to argue that HNA is an important way of identifying inequalities within the local community. This essay has critically analysed the ethical aspects of a case scenario which was based on the breaching of patients confidentiality. It reflects on the importance of consent and disclosure of confidential information and in addition it presents a balanced argument for potential harm of non-disclosure to all parties involved. Furthermore it has discussed and critically analysed the principles of legislation such as the Data Protection Act 1998 and the conflicts that arise through other Acts, in  particular the Human Rights Act 1998 and the Equality Act 2010. Penultimately this essay discusses how the use of the utilitarian and deontological perspectives can help an individual to formulate a legal resolution. Finally the case scenario emphasises the necessity for codes of conduct and legislation in a health and social care setting. These are in place to guide the professional to act in an appropriate legal and ethical manner.
